Did RKO simply chop out footage for reuse in the remake or is the cut down from 83m to 75m (the Pathé Exchange 35mm prints) a legitimate shorter cut of the film that Lobster did not try to restore to its original length?

I'm not an expert on the film, Eric; all I know is the original US and UK runtime was registered as 83:43. All cuts appear to have been carried out after the Production Code was enforced in 1934. Whether they were to adhere to the more stringent rules, cannibalising it for the 1938 remake or both, I don't know. What I am quite certain of is that Kino's transfer was not restored more fully because of someone not paying due diligence, that's all.
The bottom line is, it is cut from it's original international release length.
PS: The DVD comparison's footnotes re John Wayne are misplaced: he doesn't appear in this film.
